Fanning makes first appearance before judge

CAMP VERDE - Tessa Fanning was in Yavapai County Superior Court Tuesday in the first formal movement on her three charges of alleged sexual conduct with a minor two years ago.

The prosecution is represented by the Coconino County Attorney's Office. Fanning, 22, Cottonwood, is represented by Tom Kelly of Prescott.

Kelly told Judge Jennifer Campbell that he had filed a motion to continue the appearance, but it did not reach the court in time.

Kelly said he is asking for a 30-day continuance, and intends to present mitigating information.

The Coconino prosecutor appeared by telephone and asked the judge if that would be OK during the next appearance. Judge Campbell said that would only be appropriate if there were nothing substantive to be heard.

The calendar scheduling had called for a Rule 123 hearing used to limit public access to judicial records in the case.

Well at least the woman isn't being charged or tried by Yavapai County Attorney Sheila Polk and her minions, because they would call it a domestic case for civil court because she's a women. Felony charges don't apply to women in Yavapai County Attorney's Office.

@Walter McIntosh-As a friend of the minor and family I can assure you that it did not suddenly "rear its ugly head". This has been an ongoing investigation with the Yavapai County Sheriff's Office since 2011. Nobody is out for revenge or Political Payback. This is about a family doing the right thing for their child.

Jody Fanning is one hell of a police chief. My heart goes out to his daughter as well as his family. The negative post that have been said regarding this case have been made by people who have broken the law and blame it on Cottonwood P.D. So let's keep the negative feedback to ourselves and let this play out in Court.

I agree with Walter. The police chief got this delayed for 2 yrs and tried to help his daughter evade justice. I'm glad the teen girl's family is finally getting their day in court even with the influence of our police chief and his cronies on the system!

Let's give credit to the Verde Independent for having the gumption to cover this story even under duress from the 'Friends of the Chief'
