Letter: Polk wrong about Harborside marijuana dispensary
8/7/2012 6:13:00 PM
Editor:
We would like to kindly request a correction to the My Turn "Arizona's Medical Marijuana: Facts tell real story" by Sheila Polk.
In the opinion piece, Polk states, "In California, the U.S. Attorney recently seized the Oakland and San Jose locations of the Harborside Health Center, adding to the list of dispensaries already shut down by the federal government in that state." This is incorrect. While the U.S. Attorney did send property forfeiture notices to the Oakland and San Jose locations of Harborside Health Center, the dispensary is still open and operating daily.

Sheila Polk responds, "I stand corrected - to a very limited extent." She points out that the U.S. Justice Department, as reported in the Los Angeles Times on July 11, is moving to shut down Harborside Health Center by filing a forfeiture lawsuit to seize the properties. "That is a step they must take in order to seize the properties which will result in the closure of the dispensary."
